As you might expect, as the son and grandson of a retired Federal law enforcement officer I was very pleased to read about your recent article titled “The Criminal's Fairness Doctrine” in your magazine, “Law Enforcement Magazine.”
I have a few suggestions. First, I would like you to reconsider your editorial conclusion: “The FBI's “fairness doctrine” is nothing less than a license to violate the civil rights of citizens — particularly blacks and Hispanics.”
The premise of your article is incorrect. The FBI is governed under a memorandum of guidance called the “Fairness Doctrine,” which includes several principles that have never been broken.
One of those principles is the principle of “individualized suspicion” or “common sense.” If it is determined that individuals (black or Hispanic) are engaged in criminal or terrorist activities, the FBI makes it clear that any potential intelligence information on these individuals has been obtained in violation of the Fourth Amendment. If that investigative step does not produce evidence of illegality, the FBI continues to pursue the other investigative steps including “the use of other less intrusive investigative techniques such as the acquisition of other evidence, a search warrant, and the use of physical force.”
I can tell you from personal experience that this principle works, and you are making a terrible mistake by arguing otherwise.
